Chapter 7 Bankruptcy is a procedure where most of an individual or married couple’s debts may be discharged. In many cases, most of the Debtor’s property is exempt from seizure under federal and state statutes. A business may also file a Chapter 7 Bankruptcy.
An individual or married couple with regular income may also be qualified to file a Chapter 13 Bankruptcy. Chapter 13 Debtors will pay a monthly payment over 3 to 5 years which will discharge most debts even if they are not paid in full. Also, Chapter 13 has features that:
- allow debtors to stay in their home while paying past due payments over time
- allow for a debtor’s driver’s license to be reinstated
- provide for lower payments on some secured debt for the duration of the Chapter 13 Plan
Chapter 11 Bankruptcy
A Chapter 11 Bankruptcy is a reorganization of a business where the owner remains in control of the company while debts are restructured. In some cases, an individual who doesn’t qualify for Chapter 13 may file an individual Chapter 11 case.
Chapter 12 Bankruptcy
The chapter of the Bankruptcy Code providing for adjustment of debts of a "family farmer," or a "family fisherman" and allows for a payment plan and greater options to deal with secured debt.
